1. Acceptance & Agreement

By using or installing the GIGAPOS application on your device, you agree to be bound by these terms and conditions. If you represent a business entity, you confirm that you have the legal authority to accept these terms on its behalf.

2. Nature of License

The user is granted a license to use the GIGAPOS application on their own computers. All intellectual property rights for the source code and design remain owned by the developer.

3. Hardware & Operating Environment Responsibility

  • The user bears full responsibility for providing computers that meet the technical specifications required to run the application.
  • The platform is not liable for any failure resulting from hardware malfunctions, conflicts with other software, or insufficient device resources such as CPU, RAM, or hard disk.

4. Backup & Data Safety

Since the application runs and stores data locally on the client's device:

  • The user is solely and ultimately responsible for performing regular, periodic backups of their data and invoices to external storage media.
  • The platform disclaims all liability for data loss resulting from hard disk failures, virus infections, disk formatting, device theft, or deletion caused by human error by device users.
⚠️ Important Notice: Back up your data daily to an external storage medium (USB, external drive, or cloud storage).

5. Annual Technical Support

  • Technical support and updates are provided through an optional annual fee.
  • If technical support fees are not renewed, the platform reserves the right to discontinue all technical assistance, bug fixes, or software updates for the client.
  • Non-renewal of technical support does not entitle the client to claim data recovery from a device that has failed or lost its contents.

6. E-Invoicing & ZATCA Integration

  • Integration with the Zakat, Tax and Customs Authority (ZATCA) requires a continuous and stable internet connection on the client's device.
  • The user bears responsibility for the accuracy of VAT number and business data. The platform is not liable for any fines resulting from internet outages at the client's premises or the inability of their local device to send invoices within the legally mandated timeframe.

7. System Updates

Obtaining software updates necessary to comply with legal and tax amendments is tied to the validity period of the "Annual Technical Support." The platform is not liable for an old version's non-compliance with ZATCA systems in case of non-renewal.

8. Financial Liability Limit

The platform's financial liability for any claims or technical defects is limited to the value of the most recent annual technical support fee actually paid by the client. No compensation is provided for business downtime or lost profits due to issues with the client's device.

9. Accessories Disclaimer

The platform is not liable for the application's incompatibility with receipt printers, barcode scanners, or cash drawers that have not been officially certified by us, or that have malfunctioned due to misuse.

10. Acceptable Use

It is prohibited to use the application in any activity that violates the laws of the Kingdom of Saudi Arabia, attempt reverse engineering, or resell the license without prior written permission.

11. Termination

In case of violation of these terms, the platform reserves the right to terminate the license and immediately deactivate the application without any financial or legal liability.

12. Governing Law & Disputes

These terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes (if any) shall be settled before the competent judicial authorities in the city of Buraydah, Al-Qassim region.
